These Terms & Conditions ("Terms") govern your use of the LeadsHello platform and services, including our SMS messaging program, operated by LeadsHello ("we," "us," or "our"). By using our services or opting in to receive messages, you agree to these Terms.

Program Description
LeadsHello sends automated and AI-assisted SMS messages on behalf of licensed insurance agents and agencies to engage with consumers who have expressed interest in insurance products. Messages may include:
- Responses to insurance quote requests
- Follow-up messages regarding insurance coverage options
- Appointment scheduling and reminders
- Customer service and support communications
Message Frequency
Message frequency varies based on your interaction. You may receive up to 10 messages per day during an active conversation. Ongoing follow-up messages are limited and will decrease over time if there is no response.
Message and Data Rates
Message and data rates may apply. Contact your wireless carrier for details about your text messaging plan.
Opt-In
By providing your phone number through an insurance quote request, lead form, or other opt-in mechanism, you consent to receive SMS messages from LeadsHello on behalf of the insurance agent or agency associated with your inquiry.
3. Opting Out
You can cancel SMS messages at any time.
Text "STOP" to any message you receive from us to unsubscribe.
After you send STOP, we will send you a confirmation message to verify that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to receive messages again, you may opt back in by texting START or by submitting a new insurance inquiry.

5. Carrier Liability
Carriers (T-Mobile, AT&T, Verizon, etc.) are not liable for delayed or undelivered messages.
6. Platform Terms of Use
Eligibility
To use the LeadsHello platform as an insurance agent or agency, you must:
- Be at least 18 years of age.
- Hold a valid insurance license in your operating state(s).
- Agree to comply with all applicable laws, including TCPA, state telemarketing regulations, and insurance industry regulations.
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Ensuring that lead data you upload or process through the platform was collected with proper consent.
- Complying with all opt-out requests and Do Not Call regulations.
Prohibited Uses
You may not use LeadsHello to:
- Send unsolicited messages to individuals who have not opted in.
- Transmit content that is illegal, threatening, abusive, or fraudulent.
- Violate TCPA, CAN-SPAM, or any applicable communications law.
- Misrepresent your identity or the purpose of communications.
- Resell or redistribute lead data obtained through the platform.
7. TCPA Compliance
LeadsHello and its users must comply with the Telephone Consumer Protection Act (TCPA). As a platform user, you acknowledge that:
- You have obtained prior express written consent before initiating automated messages to consumers.
- You will honor all opt-out requests promptly.
- You will comply with quiet hours (no messages before 8:00 AM or after 9:00 PM in the recipient's local time zone).
- You will maintain records of consent for a minimum of 4 years.

8. Fees and Billing
Platform fees are billed according to your selected subscription plan. We reserve the right to modify pricing with 30 days' notice. All fees are non-refundable unless otherwise stated.
9. Termination
We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or fail to pay fees. You may cancel your account at any time through the platform settings.
10. Disclaimer of Warranties
LeadsHello is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that messages will be delivered, that the service will be uninterrupted, or that AI-generated responses will be error-free.
11. Limitation of Liability
To the maximum extent permitted by law, LeadsHello shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service, including but not limited to lost leads, missed appointments, or regulatory penalties resulting from your use of the platform.
12. Indemnification
You agree to indemnify and hold harmless LeadsHello, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or regulation.
13. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or platform notification. Continued use of the service after changes constitutes acceptance.
